1. Acceptance of Terms
By creating an account, accessing the platform, listing an event, registering for an event, or otherwise using Tacticulture’s services, users agree to be bound by these Terms of Service and all related policies incorporated by reference.
These Terms govern access to and use of:
- Tacticulture’s website
- Marketplace functionality
- Scheduling systems
- Communications tools
- Payment functionality
- Administrative infrastructure
- Related software services
If a user does not agree to these Terms, the user may not access or use the platform.
2. Nature of the Platform
Tacticulture operates as:
- A marketplace platform
- A booking and scheduling platform
- A payment facilitation platform
- An administrative and operational infrastructure platform
Tacticulture does not:
- Conduct training activities
- Supervise live instruction
- Operate ranges or training facilities
- Provide firearms or tactical instruction
- Certify instructors or participants
- Guarantee safety, legality, quality, or outcomes of any event or instructor
All training activities listed on the platform are independently organized and conducted by third-party instructors and/or venues.
Participants voluntarily choose whether to engage with instructors, attend events, or participate in training activities.
3. User Eligibility
Users must:
- Be legally permitted to use the platform
- Be at least 18 years old (or applicable legal age)
- Comply with all applicable local, state, and federal laws
- Provide accurate account information
Tacticulture reserves the right to suspend or terminate access for users who:
- Violate platform policies
- Provide false information
- Engage in prohibited conduct
- Use the platform unlawfully
4. Instructor Independence
Instructors using the platform are independent users of the platform and are not:
- Employees of Tacticulture
- Agents of Tacticulture
- Representatives of Tacticulture
- Contractors of Tacticulture
- Joint operators with Tacticulture
Instructors are solely responsible for:
- Course content
- Training execution
- Participant management
- Firearms safety
- Tactical supervision
- Venue coordination
- Compliance with laws and regulations
- Insurance coverage
- Emergency response procedures
Tacticulture does not supervise or control instructor operations.
5. Participant Responsibility & Assumption of Risk
Participants acknowledge that:
- Firearms, tactical, survival, and related training activities may involve inherent risks
- Participation may result in serious bodily injury, disability, or death
- Participants voluntarily choose whether to attend and participate in any listed activity
Participants are solely responsible for:
- Evaluating their own fitness and readiness
- Compliance with instructor and venue rules
- Safe conduct during participation
- Compliance with applicable laws
Additional event-specific waivers may apply.
6. Marketplace Listings & Promotional Services
Tacticulture may provide:
- Marketplace visibility
- Search and discovery functionality
- Communications tools
- Promotional features
- Featured listings
- Audience engagement tools
Marketplace visibility or promotional placement does not constitute:
- Endorsement
- Certification
- Tactical approval
- Safety validation
- Verification of competency
Tacticulture does not guarantee:
- Event attendance
- Instructor success
- Participant acquisition
- Revenue outcomes
- Commercial performance
7. Payments & Transactions
Tacticulture may facilitate payment processing through third-party providers.
Users acknowledge:
- Payment processing services may be governed by third-party terms
- Tacticulture is not a bank or financial institution
- Refund policies may vary by instructor, event, or venue
Tacticulture reserves the right to:
- Hold payouts in cases of fraud investigation
- Suspend transactions involving suspected violations
- Remove listings violating platform policies
8. Insurance & Compliance
Instructors are solely responsible for:
- Determining appropriate insurance coverage
- Maintaining legally required licenses or certifications
- Ensuring legal compliance for all training activities
Tacticulture does not verify:
- Insurance sufficiency
- Instructor qualifications
- Legal compliance
- Tactical competency
This applies unless explicitly stated otherwise in writing.
9. Prohibited Activities
Users may not use the platform for:
- Illegal conduct
- Unlawful firearms activity
- Extremist or violent unlawful activity
- Fraudulent listings
- Unsafe or reckless conduct
- Harassment or threats
- Misrepresentation
- Violations of applicable law
Tacticulture reserves the right to:
- Remove content
- Suspend accounts
- Terminate platform access
- Cooperate with law enforcement where legally required
10. User Content
Users retain ownership of content they upload to the platform.
By submitting content, users grant Tacticulture a limited license to:
- Display
- Host
- Reproduce
- Distribute
- Promote
This license applies to such content in connection with platform operations and marketplace functionality.
Users represent that uploaded content:
- Is accurate
- Does not violate applicable law
- Does not infringe third-party rights
11. Privacy
Use of the platform is subject to Tacticulture’s Privacy Policy.
Users acknowledge that Tacticulture may collect and process information related to:
- Accounts
- Registrations
- Communications
- Payments
- Event participation
- Operational platform usage
12. Third-Party Venues & Services
Tacticulture may integrate with or reference:
- Third-party ranges
- Venues
- Payment providers
- Software providers
- Communications services
Tacticulture is not responsible for:
- Third-party services
- Venue operations
- Range safety
- Third-party system availability
- Actions of instructors or venues
13. Disclaimer of Warranties
The platform is provided “as is” and “as available.”
To the maximum extent permitted by law, Tacticulture disclaims all warranties, including:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
- Operational reliability
- Safety guarantees
- Event quality guarantees
Tacticulture does not guarantee:
- Continuous platform availability
- Error-free operation
- Event outcomes
- Instructor performance
- Participant safety
14. Limitation of Liability
To the fullest extent permitted by law, Tacticulture shall not be liable for:
- Injuries
- Death
- Property damage
- Training-related incidents
- Firearms-related incidents
- Venue-related incidents
- User conduct
- Lost profits
- Lost business opportunities
- Indirect or consequential damages
Tacticulture’s aggregate liability should be limited to the amount paid by the user to the platform during a defined period preceding the claim.
15. Indemnification
Users agree to indemnify and hold harmless Tacticulture and its affiliates from claims arising out of:
- Training activities
- User conduct
- Violations of law
- Breach of these Terms
- Negligence or misconduct
- Uploaded content
- Firearms or tactical activities conducted by users
16. Account Suspension & Termination
Tacticulture reserves the right to:
- Suspend accounts
- Remove listings
- Restrict access
- Terminate platform participation
for violations of:
- Applicable laws
- Platform policies
- Safety standards
- Payment policies
- Prohibited activity rules
17. Dispute Resolution
This section governs how disputes between you and Tacticulture will be resolved.
- Governing Law. These Terms, and any dispute arising out of or relating to your use of the platform, are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles.
- Agreement to Arbitrate. You and Tacticulture agree that any dispute, claim, or controversy arising out of or relating to these Terms, your use of the platform, or any services provided through the platform (a "Dispute") will be resolved through binding, individual arbitration rather than in court, except as described below.
- Arbitration Procedures. Arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules (or Commercial Arbitration Rules, if the claimant is a business), then in effect, and will take place in Walton County, Florida, or by video conference or written submission if both parties agree. This agreement to arbitrate is governed by the Federal Arbitration Act, and the arbitrator’s decision is final and binding.
- Class Action Waiver. Disputes will be resolved on an individual basis only. Neither party may bring or participate in a class, collective, or representative action, and the arbitrator may not consolidate more than one party’s claims.
- Exceptions. Either party may bring an individual claim in small claims court, or seek injunctive relief in court to prevent actual or threatened misuse of intellectual property or unauthorized platform access.
- Right to Opt Out. You may opt out of this arbitration agreement by emailing info@tacticulture.com within 30 days of first accepting these Terms, with your name, account email, and a clear statement that you are opting out. If you opt out, Disputes will be resolved in the state or federal courts of Walton County, Florida, and both parties waive any right to a jury trial.
- Venue. For any Dispute not subject to arbitration, you and Tacticulture consent to the exclusive jurisdiction of the state and federal courts located in Walton County, Florida.
18. Modification of Terms
Tacticulture reserves the right to modify these Terms periodically.
Continued use of the platform following updates constitutes acceptance of revised Terms.
19. Governing Principle
Tacticulture provides marketplace infrastructure, software systems, communications tools, administrative functionality, and transaction facilitation.
Instructors independently conduct and manage all training activities listed through the platform.
Participants voluntarily choose whether to engage in such activities and assume associated risks.
Text Messaging
Text message notifications are optional and require your explicit opt-in through your account profile settings. Messages are limited to first-party, transactional account notifications (booking confirmations, waitlist alerts, and instructor messages) and are never used for third-party marketing. Reply STOP to opt out or HELP for help; message and data rates may apply. Mobile information and messaging consent are not shared with third parties or affiliates for marketing or promotional purposes.
